ABSTRACT
The building safety crisis following the Grenfell Tower Fire has had a devastating impact on leaseholders in England and created public safety risks. In response, the UK government has put together a package of non-legislative and legislative reforms. The primary legislative measure is the Building Safety Act 2022, which received Royal Assent on 28 April 2022. This is a broad and complex statute but the chapter focuses on those measures that are designed to assist leaseholders, and illustrate ways in which they build on private law concepts, whilst also highlighting surprising departures from core ideas commonly associated with private law. This chapter thus examines private law through the lens of the UK building safety crisis.
