In Roberts v Soldiers, Sailors and Airmen and Families Association – Forces Help [2020] EWCA Civ 926; [2021] 2 WLR 87 the Court of Appeal had to determine that issue, and rejecting both academic commentary and the views expressed by the Law Commission, held that the right of contribution under the Civil Liability (Contribution) Act 1978 (the 1978 Act) was to be determined solely by reference to English law, irrespective of the law which governed the relevant cause of action …”
