“Earlier this month, the Supreme Court handed down its decision in the matter of Barclays Bank plc v Various Claimants [2020] UKSC 13. In reversing the Court of Appeal’s decision, the Supreme Court has reinforced the ability of companies to use the ‘independent contractor defence’ when faced with claims in respect of third party contractors. Companies (and employers more generally) may take some comfort from the decision, as they are now less likely to be held accountable for the actions of third party contractors …” (more)
