ABSTRACT
Prior to recent times, originality and inventiveness were exclusively human activities and their protection systems, namely, intellectual property (IP) law, are set up in a way that motivates and enhances human creativity. Technology today, such as artificial intelligence (AI), is challenging this ancient and self-evident assumption. This chapter analyses issues pertaining to authorship of protectable works created by the use of AI. It traces the concept of authorship as creative human being in the existing copyright laws. Further, the chapter discusses the impact of AI on patent law. It then outlines a roadmap on how IP laws (particularly copyright and patent laws) and policy should respond to the wave of AI developments.
