Branislav Hazucha, ‘Online Content Removal in the Eyes of Copyright Users: The Role of Harm and Wrongful Gain’

ABSTRACT
A number of online content removals on social networks that allow sharing of user-generated content have recently caused a notable outcry and drawn public attention. This is particularly the case where the removals were automated, the removed content relied upon a handful of copyright exceptions for transformative uses, such as parody, criticism and research, and noteworthy divergences existed between the scopes of individual exceptions in different jurisdictions.

This article therefore examines how the general public living in diverse cultural, social and legal environments and traditions perceives the appropriateness of such online content removals. It relies upon two online surveys (each with 2,000 respondents) conducted in four major jurisdictions spread across three continents, the US, Japan, France and Germany (500 respondents from each country). The analysis of collected data shows several commonalities and differences
