ABSTRACT
The objective of this paper is to understand the purpose of implementing a Uniform Civil Code. The paper will analyse the issue as to whether a Uniform Civil Code is desirable and feasible in India, with respect to succession and inheritance laws. Under desirability, the paper will address the issue regarding whether implementing a Uniform Civil Code would ensure gender equality and uphold the spirit of secularism. While under feasibility it would raise the issue concerning whether a Uniform Civil Code is feasible given the diverse range of religions and cultures present in India. It will further address the issue of whether the implementation of a Uniform Civil Code is a command as per the constitution or merely an obiter dictum. Lastly, in the conclusion, the paper will provide suggestions as to how the government can go about enforcing and implanting the Code. The paper will draw references from the 2018 consultation paper drafted by the Law Commission of India on ‘Reform of Family Law’.
