ABSTRACT
Initially designed for military purposes, Global Navigation Satellite Systems (GNSS) are now used for a variety of civil applications. Our advanced modern societies are increasingly dependent on the services offered by these technologies. Nevertheless, such dependence does not come without risks, especially from a legal perspective. The concept of ‘GNSS liability’ has been on the agenda of the European regulator ever since 1990s. Over the years, several analyses were initiated containing recommendations and proposing various solutions for a legal framework concerning GNSS, including suggestions on liability matters of concern. Despite such on-going preoccupations, currently there is no legal instrument specifically addressing the topic of GNSS liability. In such context, this paper proposes a contextualization of the GNSS liability concept in the light of European tort law. Moreover, an existing regulatory proposal, the Galileo legal/functional model, is reassessed in the light of the new Regulation 696/2021, approving the European Space Programme.
