Nicholas McBride, ‘The Cost and Value of Personal Injury Law’

ABSTRACT
This paper was published (under the title ‘Personal Injury Law’) in a collection of essays marking the retirement of Lord Sumption from the UK Supreme Court. The paper discusses Lord Sumption’s extra-judicial criticisms of personal injury law, and argues that the costs of personal injury law are harder to discern than he assumes, and that he overlooks the real value of personal injury law.
