Mathias Siems, ‘Legal Origins’

ABSTRACT
Legal scholars often classify countries into ‘legal families’. The research on ‘legal origins’ refers to this literature; yet, it then goes further as it uses distinct categories into which each country’s law is allocated in quantitative studies. Today, this line of research, which goes back to La Porta et al (1998), forms a large body of re-search across the social sciences (initially in economics but subsequently also in political science, sociology and legal scholarship). This contribution aims to provide a fair overview of the literature on legal origins, followed by a critical analysis which poses doubts about the validity and usefulness of this line of research.
